Pet Puppy Contract
Whereas, Kim Horvat hereafter called “Seller” is the owner of the pet dog further described as:

Type of Registration is Limited.
Whereas: ________________________________________________________________, hereafter called “Buyer” is desirous of Purchasing the animal described above:
Now, therefore in the consideration for the sum of ________________ dollars, the seller hereby conveys one pet dog under the following warranties and conditions with no other warranties or conditions either expressed or implied.
Pedigree: That the above described animal is a purebred dog registerable with the A.K.C. and that a registration application or individual registration has been given to buyer as of the date of purchase.
2 Week Examination Period: All of our puppies come to their respective owners in good health and we encourage you to have your veterinarian check your new puppy if you so desire.
You have 2 weeks to have scheduled an appointment with your veterinarian to inspect your puppy. That said:
1. The above described animal may for any reason be returned to the seller within 2 weeks, or as otherwise agreed in writing at the time of receipt of the dog.
2. Buyer shall assume full responsibility for the health, anatomical make-up, appearance and temperament of the above described animal during said 2 week period.
3. If the condition of the animal has been changed in any of the categories mentioned above, the seller is relieved of the obligation to return the purchase amount in full.
Otherwise the full purchase price will be refunded upon receipt of the above described animal. Any claim of damage to the animal by the seller must be communicated to buyer within 72 hours of receipt of dog.
Health Guarantees: Every possible precaution and health screening available to the breed have been exercised in our breeding program. All animals have preliminary x-rays on their hips and a final grade at the age of 2 by the Orthopedic Foundation for Animals.

All of our breeding stock are Optigen tested for Progressive Retinal Atrophy (PRA) and CERF’d annually. We breed only to those males who are tested and suitable for breeding.

Therefore Boulder Creek Labradors will guarantee our puppies’ hips and eyes to the age of 28 months.
Hip Dysplasia: This dog is guaranteed against hip dysplasia (HD) until the age of 28 months. This guarantee will be honored providing the following qualifications have been met:
1.) The puppy/dog must still be owned by the original buyer.
2.) The puppy/dog must not have sired or whelped a litter.
3.) The puppy/dog must have documented proof of regular veterinarian care and the veterinarian must attest to this Care in a hand written notarized statement.
4.) The puppy/dog must not be over weight and this must be documented by regular vet checkups.
5.) The puppy must have been given adequate exercise throughout its lifetime. Proper muscle development will be an indicator.
6.) No record of injuries that are suspected to have contributed to said problem. In the event that there are records of pre- existing injuries and it is medically impossible to prove they were not the cause then the (HD) guarantee is voided.
In The event that HD is suspected any age prior to 28 months a hip x-ray must be taken by a qualified vet and Submitted to the Orthopedic Foundation for Animals (OFFA) for their evaluation. Buyer will also submit the puppy/dog to the Seller for examination by the Sellers Veterinarian of choice if Seller desires a second independent opinion. If the puppy/dog receives below a borderline rating the “Buyer” will submit to the “Seller” the OFA documentation and veterinary proof that the puppy/dog was sterilized. If all the above qualifications have been met at the Buyer’s expense the Buyer is eligible for a replacement puppy from the next available litter or a refund in the amount of 75% of the original purchase price.
Seller’s option to obtain a second independent opinion will be paid for by the Seller.
Progressive Retinal Atrophy (PRA): This dog is guaranteed against PRA until the age of 28 months. This guarantee will be honored providing all the qualifications have been met:
1.) The puppy/dog must be owned by the original buyer.
2.) The puppy/dog must not have sired or whelped a litter.
3.) The puppy/dog must have documented proof of regular veterinarian care and the veterinarian must attest to this care in a hand written notarized statement.
In the event that PRA is suspected any time prior to the age of 28 months a certified AVCO ophthalmologist examination must be submitted to the Canine Eye Registry Foundation (CERF) for their evaluation. Buyer will also submit the puppy/dog to the Seller for examination by the Seller’s AVCO Veterinarian of choice if Seller desires a second independent opinion. If they determine that the animal has PRA, the “Buyer” will submit to the “Seller” the CERF documentation and veterinary proof that the puppy/dog has been sterilized. Providing that all of the above qualifications have been met at the buyers expense the buyer is eligible for either a replacement puppy from the next available litter or a refund in the amount of 75% of the original purchase price.
Seller’s option to obtain a second independent opinion will be paid for by the Seller.
Limited Registration Terms and Conditions
1. The above animal is for pet purposes only and must be spayed or neutered by a qualified veterinarian no sooner than 6 months and no later than 1 year of age. A certificate of proof that the animal was spayed or neutered must be submitted to the seller for their records.
2. This puppy will be a house dog and considered a member of the family for the lifetime of the dog. This puppy will not be tied out or chained.
3. Buyer agrees to transport animal in a kennel crate maintained in the vehicle or some other approved vehicle restraint such as a dog harness that attaches to the seat belt.
4. Buyer agrees that the said puppy will never ride in the back of an open pickup truck unattended on the highway for any reason.
5. Buyer agrees that the puppy will not be neglected in any manner or mistreated.
6. Buyer agrees to provide:
a. Adequate housing and proper protection from the weather and other animals.
b. That the puppy will be sufficiently fed and always have and ample supply of fresh clean water.
c. Buyer agrees that the puppy shall receive regular veterinary care throughout its lifetime and that all inoculations will be maintained so long as the dog shall live.
d. Buyer must have or will have a fenced in yard to maintain their puppy.
7. Buyer agrees that the puppy will not be kenneled (with a closed door) in the house more than 4 hours at a time unless it is night time.
8. Buyer also agrees to exercise said puppy daily as needed meaning as your puppy grows it will require more exercise.
If the Seller discovers that the Buyer is not complying with the Buyers obligations in line items 1-8 listed above the Seller shall have the right to rescind the sale and provide the Buyer with a pro rated refund based upon a 10 year life expectancy minus expenses to the seller. Expenses include but are not limited to: boarding, grooming, veterinarian care and advertising.
Sellers Right to Refusal: The Buyer guarantees the Seller the “The Right of Refusal” if the puppy is to be sold or dispensed of in any manner. In the event the puppy is returned in its lifetime the buyer’s cost are limited to the original cost of the puppy. Any consequential costs to the seller such as boarding, grooming, veterinarian expenses and or advertising shall be deducted from the original purchase price.

In order to receive an adjustment under the terms of this contract:
